2022 FUJIFILM DESERT DAZE PHOTOGRAPHIC IMAGE CONTEST

OFFICIAL CONTEST RULES

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

NOTE: THE THREE (3) DECLARED WINNERS OF THIS CONTEST WILL BE REQUIRED TO ATTEND AT LEAST ONE (1) DAY OF THE DESERT DAZE MUSIC FESTIVAL TO BE HELD IN LAKE PARIS, CALIFORNIA DURING THE PERIOD SEPTEMBER 30 – OCTOBER 2, 2022. Contest winners will receive mentoring from a Fujifilm photographer during the event and beforehand from a dedicated Desert Daze photographer, as they create a short film based on Festival performances and activities. The short film will be posted and promoted by Fujifilm and Festival Event organizers with creator credit and attribution.

1. Description. The 2022 FUJIFILM Desert Daze Photographic Image Contest (the “Promotion” or the “Contest”) is sponsored by FUJIFILM North America Corporation, 200 Summit Lake Drive, Valhalla, NY 10595, with the assistance of its advertising and promotional agencies (collectively, “Fujifilm” or “Sponsor”). The Contest winners will be selected, and the entries will be judged, based on a 200 word limit, written submission explaining why the short film project is meaningful and appealing to the entrant, plus a single, uploaded photographic image that reflects the entrant’s personal photographic style to be used in creating the short film if declared a winner.

The 3 declared Contest winners will receive an incredible, unique prize package consisting of the following:

(i) a single, Sponsor selected FUJIFILM X Series digital camera and lens product (ARV up to USD $2,499);

(ii) complimentary admission and media pass to all days of the September 30 – October 2, 2022 Desert Daze music festival to be held at Lake Paris, CA (the “Festival”) (ARV $749);

(iii) Camping pass for camping at the Festival camp grounds during the 4 day period Thursday, September 29, 2022 through Monday, October 3, 2022 (ARV $ 99). NOTE: sleeping bag, camping lantern, and other necessary camping equipment is NOT included;

(iv) Festival meal package covering 2 meals per day for each day of the 3 day Festival (ARV $150)

(v) Complimentary vehicle parking pass for 3 days of the Festival (ARV $179);

(vi) A travel stipend in the amount of $750 to assist the winner with travel and Festival-related expenses (ARV $750);

(vii) An opportunity to obtain photography and videography tips regarding concert / music event short film creation from the dedicated Desert Daze Festival photographer before the Festival (ARV $500);

(viii) An opportunity to receive photography tips and technical assistance from a Fujifilm technician or Creator during at least one day of the Festival (ARV up to $1,500);

(ix) Fujifilm’s posting and publication of the winner’s created short film, and linking to, and promotion of, the winner’s Instagram profile and personal website (if applicable) in various marketing materials to promote the Contest winner’s story-telling activities and capabilities, from the Festival or otherwise as Fujifilm deems appropriate (ARV up to $2,000).

As indicated above, each Contest winner will be required to attend at least 1 day of the Festival, and is expected to use the provided FUJIFILM X Series digital camera and lens product to shoot, edit and produce a short film relating to the Festival to be used in marketing and promotional materials of both Fujifilm and the Festival event organizers after the Festival. In connection with the short film production, Contest winners will be required to sign a license and consent agreement with Fujifilm covering Fujifilm’s license to use the created short film, to link to the winner’s website and social media accounts (including Instagram profile), and to use the winner’s name, voice, likeness, Behind the Scenes video footage and interview content regarding his or her short film project and the awarded Festival opportunity. Fujifilm will work with Festival event organizers and the prize winners to put into place necessary third party model, music and property releases covering each winner’s short film content.

2. Eligibility: The Contest is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old at the time of Contest entry. Limit one (1) entry per person and per email address. Employees of FUJIFILM North America Corporation, the advertising / administrative agency managing this promotion, and any of their parent and affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible to enter or to win. The Promotion is subject to all applicable federal, state, and local laws and regulations and is void where prohibited.

3. Agreement to Official Rules and Fujifilm’s Determinations: Participation in this Promotion constitutes entrant’s full and unconditional agreement to these Official Rules and to the Sponsor’s decisions, which are final and binding in all matters related to this Promotion. Being declared a prize winner and being awarded a prize is contingent upon fulfilling all requirements set forth herein.

4. Contest Phases and Timing: The Contest begins on August 4, 2022 10:00 A.M. Pacific Time (“PT”) and ends on August 25, 2022 at 11:59 p.m. PT (the “Promotion Period”). The Contest consists of various phases and timetables as set forth in the chart below.

Sponsor’s computer system is the official time-keeping device for the Promotion.

5. How to Enter: During the applicable Submission Phase of the Contest, entrants should visit desertdaze.org/fujifilm and follow the links and instructions to upload one (1) original photographic image taken/created by the entrant himself/herself, and to complete a 200 word limit, written statement of interest as described below. Entrants must submit the applicable image and written statement, along with the fully completed official Contest Entry Form found at desertdaze.org/fujifilm, following the entry form and uploading instructions included there.

The Contest Entry Form requires that each entrant provide full name, a valid email and resident U.S. street address (no P.O. Boxes), cell phone number, and confirmation that they meet the age and residence requirements as a condition to entering this Contest. Professional photographers may enter, but their image submission must not have been previously published or publicly displayed. Your uploaded image file for the Contest is hereafter referred to as your “Image Submission”. By uploading your Image Submission, you represent that your Image Submission was your sole creation, that it conforms to the Content guidelines and restrictions listed below (collectively, the “Guidelines and Restrictions”), and that Sponsor, in its sole discretion, may remove your Submission and disqualify you from the Contest without notice if it believes that your Submission fails to conform to the Guidelines and Restrictions. Please note that in no event will your Submission be returned to you. Unless otherwise specifically agreed with you in writing, your Submission will be used by Sponsors exclusively for purposes of determining the winner of the Contest as described.

Submission Guidelines:

• The Image Submission must consist of a single (1) uploaded photographic image which is reflective of the entrant’s preferred photographic style. All images must be in .jpg or PNG form, and max file size: 10Mb. All EXIF and Metadata for the image must be provided.

• The Image Submission must have been created solely by the entrant and may not have been submitted previously in a promotion of for publication of any kind;

• The Image Submission must not include material that violates or infringes another’s rights, including but not limited to a third party’s privacy, publicity or intellectual property rights, or that constitutes copyright infringement. This means that the entrant/creator of the Image Submission must have obtained the permission or consent of all persons depicted in the image for the entry of the Image Submission into the Contest, and if requested, entrant must be able to provide such permissions in a form reasonably acceptable to Sponsor;

• The Image Submission must not reflect the disparagement of, or be likely to disparage or ridicule, Fujifilm or the Festival event organizers;

• The Image Submission must not include third party artwork, brand names or trademarks, including street art, graffiti, brand logos, and visual graphics that are not owned or created by the entrant;

• The Image Submission must not include any material that is inappropriate, indecent, obscene, hateful, tortious, defamatory, slanderous or libelous;

• The Image Submission must not include or reflect material that promotes bigotry, racism, hatred or harm against any group or individual or that could be deemed to promote discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; and

• The Image Submission must not include or depict material that is unlawful, or depict actions or activity that could be deemed in violation of or contrary to the laws or regulations of any state (including illegal drug use, gun violence, prostitution, gang activity and the like).

For All Entries: Limit one entry per person, per email address. Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant’s entries and that entrant may be disqualified. Use of any automated program to enter will result in disqualification. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, defective or misdirected entries or Image Submissions, which will be disqualified. In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. Potential winners may be required to show proof of being the authorized account holder. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.

6. Winner Determination: Winners will be determined during the Judging Phase, when a panel of not less than three (3) qualified judges determined by Sponsor in its sole discretion will judge the written entry submissions and the Image Submissions based on the following criteria:

• Written Submission (35%)

• Image Submission (weighted 65%), based on

• Overall Representation of a particular photographic style (20%)

• Emotional Impact (25%)

• Suitability of photographic style for the Festival short film (20%)

A total of three (3) Contest winners will be selected. The three (3) entrants with the highest-scoring Submissions based on the criteria and weighting described above, as subjectively determined by the panel of judges will be deemed a Contest winner. The scoring of the panel of judges will be final in all instances respecting this Contest. In the event of a tie, the entrant who received the highest “Emotional Impact” score, as determined by the judges in their sole discretion, will be deemed the winner. The winners will be notified by email to the email address provided on the Entry Form on or around September 1, 2022 as referenced in the Section 4. Timing section above

7. Winner Requirements: As referenced above, each Winner of this Contest is required to attend at least one (1) day of the Festival, and to create a unique short film based on Festival performances and activities. Excepting the travel stipend and the other specified elements of the provided prize package, travel to the Festival and the cost of all Festival activities and events will be at the Winner’s sole expense.

Except where prohibited, each potential winner will be required to sign and return a Declaration of Compliance, Liability and Publicity Release, a Photographic Image and Video (Short Film) License, and any other forms requested by Sponsor, all of which must be received by Sponsor without modification and in the form provided within five (5) business days of the date notice or attempted notice is sent, in order to claim the applicable prize. Information required will include a valid social security number, and all potential winners must provide his/her social security number to Sponsor as a condition to being awarded the prize, so that proper 1099 documents can be issued at the prize value. If a potential winner cannot be contacted, fails to execute and return the documentation in the form provided, without modification, and as requested by Sponsor, fails to commit to attend at least one (1) day of the Festival, or fails to provide any other requested information within the required time period, does not comply with these Official Rules, or if Sponsor’s communications are returned as undeliverable, the potential winner forfeits the prize. If a potential Contest winner is disqualified for any reason, the prize may be awarded to a runnerup determined by the judges, if any, in Sponsor’s sole discretion.

Acceptance of any prize shall constitute and signify each winner’s agreement and consent that Sponsor and its designees, including the Released Parties (defined in Section 9, below) may use the winner’s name, city, state, likeness, Image Submission, prize information and produced short film for promotional, advertising or other purposes, worldwide, in any and all media now known or hereafter devised, including the Internet, for a period of 24 months from the date of completion of the short film, without limitation and without further payment, notification, permission or other consideration, except where prohibited by law, provided that Sponsor will include standard creator / photographer attribution with all such uses.

8. Prize Package and Winner Requirements / Expectations:

3 CONTEST WINNERS: A prize package consisting of the following will be provided to each Contest winner:

(i) a single, Sponsor selected FUJIFILM X Series digital camera and lens product (ARV up to USD $2,499);

(ii) complimentary admission to all days of the September 30 – October 2, 2022 Desert Daze music festival to be held at Lake Paris, CA (the “Festival”) (ARV $749);

(iii) Camping pass and tent rental for camping at the Festival camp grounds (ARV $99); Thursday, September 29 – Monday, October 3, 2022. No camping equipment provided.

(iv) Festival meal package covering 2 meals per day at the Festival (ARV $150)

(v) Complimentary vehicle parking pass for 3 days of the Festival (ARV $179);

(vi) A travel stipend in the amount of $750 to assist the winner with travel and Festival-related expenses (ARV $750);

(vii) An opportunity to obtain photography and videography tips regarding concert / music event short film creation from the dedicated Desert Daze Festival photographer before the Festival (ARV $500);

(viii) An opportunity to receive photography tips and technical assistance from a Fujifilm technician or Creator during one day of the festival (ARV $1,500);

(ix) Fujifilm’s posting and publication of the winner’s created short film, and linking to, and promotion of, the winner’s Instagram profile and personal website (if applicable) in various marketing materials to promote the Contest winner’s story-telling activities and capabilities, from the Festival or otherwise as Fujifilm deems appropriate (ARV up to $2,000).

Approximate Retail Value (“ARV”) of each prize package to be awarded: estimated up to USD $8,426. Aggregate ARV of all prizes to be awarded in connection with this Promotion: estimated up to USD $25,278. Any items not specifically referenced in this prize package are NOT included, and will be the sole responsibility of the prize winner, along with any incidental Festival expenses.

Prizes will be provided promptly after all Contest winners have been notified and verified, generally within 2 weeks from the end of the Promotion.

ARV is subject to price fluctuations in the consumer marketplace based on, among other things, any gap in time between the date the ARV is estimated for purposes of these Official Rules and the date the prize is awarded or redeemed. Prizes are nontransferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason. Winners are responsible for all taxes and fees associated with prize receipt and/or use, and winners acknowledge that a 1099 will be issued by Sponsor for the ARV of the prize.

As set forth below, Sponsor shall have the right to re-post, forward, link to or otherwise digitally promote (including without limitation, through website or social media postings) the winner’s Image Submission and various related social media postings and content, either with or without Sponsor’s own promotional content. However, in the event Sponsor wishes to make any further commercial use of any winner’s previously created images or video (such as in connection with print advertising of Sponsor’s FUJIFILM-branded products), the Sponsor will discuss the terms of any such further commercial use with the applicable winner and execute a mutually agreed written license agreement with the winner relating to any such further commercial use.

9. Release: By acceptance of any prize, each winner agrees that the prize package is personal to the winner, and that he/she will not sell, offer for sale, assign or transfer to any third party, any elements of the prize package. The FUJIFILM X Series digital camera and lens, specifically, may not be sold, offered for sale, or transferred to any third party for a period of eighteen (18) months from receipt. By acceptance, each prize winner agrees that he/she releases and holds harmless the Sponsor, the Festival organizers and sponsors (including without limitation Desert Daze), their affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Promotion; the receipt, use or misuse of any prize; and attendance at the Festival (including without limitation, all Festival activities or occurrences).

10. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the Promotion, as determined by Sponsor in its sole discretion. If Sponsor terminates the Promotion, Sponsor may, in its sole discretion, determine the winners from among all nonsuspect, eligible Submissions received up to time of such action using the judging procedure outlined above. Sponsor, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the Submission process or the operation of the Promotion or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner and void all associated Image Submissions and/or Entries. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages and other remedies (including attorneys’ fees) from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

11. Limitations of Liability: Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrant, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the submission process or any other portion of the Promotion; (4) printing, typographical, technical, computer, network or human error which may occur in the administration of the Promotion, the uploading, the processing or judging of Submissions or votes or the tabulating of votes, the announcement of the prizes or in any Promotionrelated materials; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt or use or misuse of any prize (including any travel/activity related thereto). Released Parties are not responsible for misdirected or undeliverable Submissions or for any technical problems, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Released Parties are not responsible for any unauthorized third party use of any Submission/Entry.

12. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by a state court located within the state of New York; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of New York without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.

14. Winner List: For the identity of the Contest winners, visit www.studentsofstorytelling.com. The winners will be posted after winner confirmation is complete and will remain posted in any event until December 31, 2022. Alternatively, you may send a SASE to “The 2022 FUJIFILM Desert Daze Photographic Image Contest Winner’s List,” FUJIFILM North America Corporation, Electronic Imaging Division, 200 Summit Lake Drive, Valhalla, New York 10595, by December 31, 2022.
